1. Introduction

Welcome to Biblion ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our book cataloguing application, website, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Biblion provides book collectors with tools to catalogue their libraries. Our Service includes:

  • ISBN Barcode Scanning: Scanning book barcodes to auto-populate metadata (title, author, publisher, year, format) using the OpenLibrary API.
  • AI Title Page Scanning: Using artificial intelligence to extract book details from photos of title pages.
  • Collection Management: Organising books, creating collections, and exporting data (e.g., insurance reports).
  • Credit System: A virtual currency used to pay for scans and photo uploads (see Section 5).

3. User Accounts

3.1 Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials confidential.
  • Notify us immediately of any unauthorised use of your account.
  • You must be at least 16 years old to use the Service.

3.2 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that violates these Terms, is harmful to other users, or for any other reason.

4. User Content & Conduct

4.1 Your Content

You retain ownership of the content you upload (photos, book lists, notes). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely to provide the Service to you.

4.2 Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Post or transmit any unlawful, threatening, defamatory, or obscene material.
  • Introduce viruses, malware, or any harmful code.
  • Attempt to gain unauthorised access to our systems or other users' accounts.

5. Credits & Payments

5.1 Credit System

Biblion operates on a credit-based system. Credits are used to perform scans and upload photos:

  • Barcode Scan: 2 credits per scan.
  • AI Title Page Scan: 10 credits per scan.
  • Photo Upload: 1 credit per upload.

Credits are non-refundable and have no monetary value outside the Service.

5.2 Subscription Plans

We offer various subscription tiers (Free, Starter, Builder, Pro, Elite) with different monthly credit allowances and book limits. Subscription fees are charged in advance and are non-refundable except as required by law.

5.3 Payments

All payments are processed through Stripe. By subscribing, you agree to the terms of Stripe's payment processing. Your subscription will automatically renew unless you cancel it at least 24 hours before the renewal date.

6. Intellectual Property

All content, features, and functionality of the Service (including text, graphics, logos, and software) are owned by Biblion and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Third-Party Services

Our Service integrates with third-party services, including:

  • OpenLibrary API: Used for barcode scanning metadata.
  • Stripe: Used for payment processing.
  • Google/AI services: Used for AI title page scanning.

We are not responsible for the practices or content of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

8. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Biblion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective Date". Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
